How Much Is My Case Worth Following an Offshore Injury?

| Read Time: 3 minutes

Anyone who works in the Gulf of Mexico or other coastal waters faces the constant risk of offshore injury. The waters of the gulf are home to myriad high-risk industries, ranging from maritime transport to offshore oil rigs. However, serious injuries can occur in any U.S. waterways. If you or a loved one suffered an offshore injury, you are likely wondering about the potential value of your claim. The best way to determine how much your offshore injury case might be worth is to consult an offshore injury lawyer. How Much Is My Case Worth? Can an Offshore Injury Lawyer Tell Me? Because many factors affect the value of a claim, it is not possible to estimate the average value of an offshore injury.  However, if your injuries require extensive treatment, you need to know how you will pay your medical bills. If you can’t return to work, you deserve to know how you’re going to pay your bills and living expenses. If your family depends on your income to survive, you need someone who will fight for every dollar you deserve. To determine what your case might be worth, talk to an experienced maritime injury attorney. Your attorney can evaluate the unique circumstances of your case and estimate how much you may be able to recover. How Are Maritime Injury Claims Calculated? Lawyers calculate the value of any personal injury, including those caused by offshore accidents, based on the actual damages or losses the victim has suffered. Most types of work-related injury claims are governed by state laws. Job-related offshore injuries to seamen, however, fall under the federal statute known as the Jones Act. If you sustained injuries while working an offshore job, the Jones Act allows you to pursue damages such as: Lost wages, Medical care, Pain and suffering, Mental health treatment, Lost earning capacity, Vocational rehabilitation, Living expenses, and Future treatment and care. In the case of a fatal offshore accident, the Jones Act provides relief for the victim’s family.  In some cases, the Death on the High Seas Act (DOSHA) provides a cause of action for the families of individuals killed as the result of another’s negligence. This is a claim that is available for individuals who do not qualify as a Jones Act seaman. In addition, there are several other general maritime law remedies available to individuals injured or killed while working offshore including a claim that the vessel was not in a seaworthy condition.  In addition, workers injured while working on offshore oil rigs can recover damages under a network of laws including the Jones Act, Outer Continental Shelf Lands Act (OCSLA), Longshore and Harbor Workers’ Compensation Act, and state law remedies. In short, having a knowledgeable maritime attorney in your corner is important due to the complex network of laws that apply to your case.   Do I Need an Offshore Injury Lawyer to Pursue Compensation? Having a knowledgeable advocate can help you obtain justice for your injuries and recover the maximum possible compensation for your damages. Because maritime laws are so complex, an offshore injury lawyer can determine the correct legal channels through which to pursue your case. If your injuries were not work-related—such as a cruise ship or passenger watercraft injury—your attorney can quickly determine the governing statutes for your case. Your attorney can also connect you with the resources you need to get through this horrific time in your life. Talk to a Maritime Injury Lawyer Today You don’t need to sit alone and wonder, “How much is my injury worth? You definitely don’t have to fight this battle alone. 5 Reasons Why a Personal Injury Lawyer Will Not Take Your Case

| Read Time: 3 minutes

Having an experienced personal injury lawyer on your side can be invaluable if you’ve been hurt in an accident. Your attorney will protect your legal rights and fight to get you the compensation you deserve for your medical bills, lost wages, and other damages. Contrary to what you might believe, however, accidental injury lawyers don’t accept every client who contacts them for help. Understanding the reasons an attorney might not agree to take your case could save you time and trouble. Before you decide for yourself that you don’t have a strong case, take advantage of the free consultation and case evaluation that most personal injury lawyers offer. No. 1: You Suffered Only Minor Injuries To recover a substantial personal injury settlement, you must have suffered serious injuries. Although the definition of a serious injury is obviously subjective, this term typically refers to those injuries that either: Require extensive treatment, Cause long-lasting or permanent damage, Prevent you from returning to work, Diminish your earning capacity, or Diminish your quality of life. Assessing the severity of your injuries is difficult to do on your own. To determine if you have a strong case, talk to an experienced personal injury attorney. No. 2: You Waited Too Long to Pursue Your Personal Injury Claim Every state has a statute of limitations that dictates how quickly you must take legal action in a personal injury case. The Texas statute of limitations, for example, provides you with two years to pursue legal action after the date of injury. The Florida statute of limitations offers a generous four years to file your claim for most types of personal injury cases. The Louisiana statute of limitations, on the other hand, is one of the most restrictive. You have only one year to file a lawsuit for most types of personal injury claims in Louisiana. It is important to understand that these are basic guidelines, and in many cases, provisions within the state laws may extend this window of opportunity. An attorney can review the facts of your case and determine if you still have time to file a personal injury claim. No. 3: The At-Fault Party Was Not Negligent We often refer to car crashes as “accidents” because, in many cases, drivers simply make mistakes. Even if you sustained serious injuries in an accident that you didn’t cause, the at-fault party is not automatically negligent. Establishing liability for your damages requires demonstrating the four components of negligence, which are: Duty of care, Breach of duty, Causation, and Actual damages. Negligence laws are complex and they vary from state to state. Talking to an attorney is the only way for you to know for certain if you have a claim based on negligence. If the at-fault party wasn’t negligent, that doesn’t automatically mean you have no case. You may be able to pursue your personal injury claim through your own insurance or a third party who may have contributed to your damages. Again, these are questions that an experienced attorney can answer for you. No. 4: You Have Little Chance of Recovering Compensation Most personal injury attorneys accept cases on a contingency basis. This means that you owe no legal fees unless the law firm recovers compensation for your damages. This is great for you, because you may already be struggling to get the treatment you need and pay your bills. However, in addition to believing you have a strong case, your attorney must believe that the at-fault party has insurance or another form of financial resources. Otherwise, even if you prevail in court, you have little chance of recovering any money from the defendant. No. 5: You’ve Been “Shopping Your Case” to Other Attorneys Although this practice is not common, some accident victims go from firm to firm, searching for whichever attorney will estimate their claim value the highest. If an attorney provides an opinion on your claim’s potential value, you generally should avoid saying something like, “Well, XYZ Law Firm said my case was worth much more!” When choosing a personal injury attorney, look for someone who has experience with your type of claim. Inquire about their years in practice. Ask how many clients they’ve helped. Ask about the firm’s track record of success for past clients. An attorney’s prior achievements may not reflect on the outcome of your case. However, knowing a law firm has gotten good results for their clients in the past means they’ll fight for you too. Fire Insurance Claims: What You Need to Know

| Read Time: 3 minutes

When you have a fire at your home or business, it can turn your world upside down. Not only do you have to worry about what you lost, but you might be displaced until the damage can be remediated and repaired. A fire insurance claim provides the resources you need to restore order to your life. If your insurance company denies your claim or doesn’t provide a timely response, you need someone on your side. An experienced insurance dispute or property damages claim lawyer understands how to get the process back on track and fight for the compensation you deserve. Potential Problems in the Fire Insurance Claim Process You pay your insurance premiums every year to ensure that you have coverage in place if the unthinkable happens. After disaster strikes, you rightfully expect your insurer to step up and pay your claim. Unfortunately, your claim can be held up for a variety of reasons. Often the problem is simply a mistake or miscommunication on the insurance company’s part. In other cases, you could encounter potential bad faith issues, where the insurer: Refuses to investigate your claim, Delays paying your claim, Undervalues your claim, Makes false or misleading statements, or Wrongfully denies your claim. Meanwhile, you have no way to restore your home or business or get reimbursed for the funds you’ve already spent. Fire Insurance Claim Tips Submitting a fire insurance claim requires documenting the damages you incurred. Typically, you must provide information and documents such as: Photographs or videos of your property before the fire, Photographs or videos of the damage the property sustained, Detailed lists of all damaged or destroyed items, and Contractor estimates for repairs. Your policy may require you to dry out, clean up, and secure your home or business immediately after a fire, storm, or any other property damage event. If so, you should also include paid receipts for the following services as part of your claim: Damage remediation, Board-up and security measures, Any item you already replaced, and Any covered out-of-pocket expenses. If you plan to submit your claim yourself, you may struggle to determine the accurate value of your claim. Estimating the value of your fire insurance claim settlement is only one part of the process where a fire insurance claims attorney can assist you. Insurance companies often significantly underestimate fire damage claims. Smoke damage often requires extensive interior repairs or replacement of personal property that cannot be fully restored to its pre-fire condition. Examples of some items that are often undervalued or overlooked by insurance companies include:  Refinishing floors;  Repainting the interior of the home;  Replacing drywall that sustained significant smoke exposure;  Fully repairing electrical and ventilation systems;  Replacing insulation;  Replacement of an entire roof rather than a patch job.  In many cases, the property owner will be required to make significant code upgrades. For example, building codes may require the home’s electrical system or roof to be fully replaced due to the extent of the damage from the fire. These are items that insurance companies tend to overlook because they cost a lot of money.  The task of creating a content list can be daunting. If you have suffered a significant fire you may have hundreds of items that have been damaged, destroyed, or are need of restoration. With our clients, we often have them start by reviewing a master list of common household items and have them work backward to create a thorough contents list.  How a Property Claims Lawyer Can Help Talking to a property claim lawyer, such as one of the fire insurance claim lawyers at the Johns Law Firm, can help at any stage of the process.
